The Eighth Amendment provides. that excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted. Preventive detentions are when someone is denied bail and release because the court fears that if the accused is released they will be a danger to the community. Congress authorized preventive detention in the Bail Reform Act of 1984, and the Court upheld the Act in United States v. Salerno, 481 U.S. 739.

When perpetrators are released without bail, they in essence are signing a written promise stating that they will return for trial. Here in Framingham they usually fail to appear until they reoffend and are brought back to the courthouse. In our opinion, Judge David "The Asshat" Cunis at the Framingham Disrtrict Court is especially lax in his bail determinations.

In our opinion, David The Asshat, does not subscribe to reasonable bail amounts or preventative detention, holding perpetual reoffenders from the community until they can be tried in court.

David The Asshat lives in Holliston, not in Framingham where his "released without bail" buddies hang out and reoffend in crimes against the residents of Framingham.

Framingham Forward asks David The Asshat to treat Framingham like the community where he and his family live, and to assume that any past reoffender is likely to be a future reoffender.

Our investigation found that in cases heard by David the Asshat, when charges were brought against persons with no history of criminal acts, bail would usually be required. However at a rate of 90%, for our chronic reoffenders, release on personal recognizance (release without bail) was the standard.

Since we at Framingham Forward do things differently, we are offering a Asshat Cunis t-shirt for purchase. We are offering these t-shirts at cost.

We recommend buying one and heading downtown where you will pick a homeless vagrant and give them a gift of a t-shirt, If you are too shy for that, just leave one in one of the planter boxes in Burkis Square for the same result.

It will only be a matter of time until a suspect winds up in court with David The Asshat while wearing a Asshat Cunis t-shirt.
